as much as im into CNC and the like, a lot of the time when gag reflexes are abused, it can cause someone to tear up (like in images where mascara is ruined with black/makeup tears streaking down someoenes face).
i HIGHLY doubt its rape because its not tagged as such and he's not trying to push them off of him or pull off their dick.

I dont think this is rape, but to get the actual answer we'd have to go to the source.
