Simplest way to avoid this: Ask before doing it.

Hell must have frozen over.

Someone didn't flip their shit over their stuff getting posted.

Kudos to you for keeping a cool head,that's unfortunately a rare trait on the Internet.

FYI in the future if you see this problem again, you can always change the tags yourself.
Just click the edit link at the bottom of the image, or to the left of the page under "Options", and change the tag to the one you want.
As long as the tags are accurate, it's ok to do.

indeed it is a dicey subject, I feel that the owner of the OC should be asked if its a commissioned artwork, due to the fact that they payed for that art so that others could enjoy it, not just for selfish purposes I would like to think but as I said befor as long as its paying proper respect to the owner then it should not be a problem.

I never said anything about what is required.

This site actually got started by not asking anyone permission for anything, and when people asked for their things to be removed, they were told to fock off.

Unfortunately getting that permission before hand can be a bit unrealistic.
If you have large orgy pics, or images where the character isn't well identified, or no contact info is given for the owner it's just not feasible.
So, realistically, we ask the artist because they're usually easy to find/identify, and if someone who owns a character takes issue then we work to remedy that afterward to the best we can.

It's just the only reasonable way to do things, otherwise we'd never have new art because of waiting on permission from so many people.

For the record? If you own a character, and you commision a piece from an artist, you are the copyright owner. "(b) Works Made for Hire. In the case of a work made for hire, the employer or other person for whom the work was prepared is considered the author for purposes of this title, and, unless the parties have expressly agreed otherwise in a written instrument signed by them, owns all of the rights comprised in the copyright." Certainly you can sign your rights away when you are commissioning a piece, if that is part of the agreement, but by default, if you're paying for it YOU are the copyright holder for that piece. http://www.copyright.gov/title17/circ92.pdf page 141 corresponds to page 126 in the table of contents, if you want to double-check the passage quoted.

That attitude has always irked me especially when it's an incorrect assumption. :/

But treating it like that is how it is by law instead of something that is negotiated with every commission is bad; If you hadn't stated it as, "the artist holds the copyright", period, and rather as "the artist usually holds the copyright", which would be far better, then I wouldn't have addressed it at all. :)

thanks for your kind words, as for posting more art of myself here, perhaps, there isn't too much i want to do over the holidays of course, soon ill be away for a week so I will only have the limited connection on my mobile to do internet stuff.

To put it simply: If I payed Walt Disney to draw Mickey Mouse in such and such way, then that EXACT image could not be used or reproduced without my consent. But if I payed him to make an anthropomorphic mouse named Micky Mouse before he thought to make the character himself, then DisneyWorld would not exist.

No. Unless he can prove he has a pre-existing idea that would cause infringement isseues with yours then your idea is protected by patent PENDING laws. And yes you need proof that its your idea and not the artist's. So save your emails when discussing commisions.
