Topic: Question about posting art of my fursona

Posted under Off Topic

I wanted to ask if I commissioned an artist to draw my fursona but did not give them permission to post it, can I request the post to be removed, or is it entirely up to the artist? Also if someone else draws my fursona from a reference sheet I provided without asking me and posts it, does this violate site rules since i am the owner of the oc? Would such a post be eligible for removal? Also have been wondering if I have an oc and someone draws a character identical or almost identical to my oc claiming they own it and post it here without my consent would that violate any rules at all by any chance or how does it work? I tried contacting the site admin from the contact page but haven't gotten any reply so I thought I would ask here, maybe somebody can help me with this, I would really appreciate the help a lot :3

Since you say you are the owner of said character, I feel you should be allowed to request deletion of content depicting your character. There is a more detailed guide on the wiki regarding taking down posts, including info about character owners' requests.

Some separation between your questions would go a long way

Artists have the final say in takedown matters, presuming you did not gain total copyright over the piece

It would almost certainly depend on the specific case. Unless it's directly attacking you I am doubtful it would be removed

Again, case by case basis. No one here can really tell you what would happen until it does
Similar OCs happen all the time with basic characters. Unless they're directly mocking you or the character is detailed and the copy is obvious it'd be near impossible to prove

You really should not worry about any of these things unless they actually happen

Let's take this a chunk at a time

Yes you can*
โ€‹* Artists have precedence on whether or not a post will be taken down, so if they don't care/object, yes you can request and have it removed. However if they do object, this is where it gets interesting, I wonder how it'll be handled (the reverse situation of artist wants it taken down and character owner wants it up is ruled in the artists favour).

No, generally not*
โ€‹* There is this line from the Code of Conduct page

Do not knowingly or repeatedly upload or share unauthorized edits of artwork after the original artist or character owner asked others not to.

but i'm not sure it can apply here. However I believe there's a rule that you can't use posts to harass people (like character owners) so I guess it depends on the post's content and how the rule is enforced. As to whether it can be taken down, see my paragraph above.

Also have been wondering if I have an oc and someone draws a character identical or almost identical to my oc claiming they own it and post it here without my consent would that violate any rules at all by any chance or how does it work?

There are rules against plagiarism , though if they draw it themselves (and don't trace) and rename, and the OC is pretty generic it'll be hard to find a case against them

I'd imagine that they'd have to take it down.

if a work contains an individual's character design, legally they should be able to request/demand its removal, regardless of the will of another party (unless it's fair use). it's their character design, the character owner owns the copyright to that character.

Character copyrights are tricky. They aren't as simple as normal copyright, as copyrighting a character brushes against copyrighting an idea, which is expressly not what copyright is for, so requires a higher degree of specificity to be copyrightable.

I'll largely point you to Donovan & SNP's excellent replies, but I'd like to ask (b/c it's not clear from the OP) whether or not you asked the artist if you can request a takedown. There's a chance they'd be cool with it, in which case (if you provide that proof in the request) there's no conflict & you can feel pretty confident it'll be taken down, & faster (though it will still likely take a while).
