Topic: DNP / Avoid Posting... a Character?

Posted under General

Not sure what category this falls under, it's more a question than anything.

I've run into a couple instances recently where an entire character was removed from the site. This tends to happen when the artist DNP's themselves and they were the characters sole artist.

But what about commissions and fanart from other artists? As far as I've been able to find, there's no list for DNP characters. So what if I draw or repost a character that was apparently removed from the site.
Not just that, what if I draw the character, post it, then years later the person has it all removed. Despite me being the artist, do I have to take it down? Will I get a warning or notification?

Just curious cause it's hard enough keeping up with artists spontaneously deleting themselves, I'm gonna need to buy a separate SSD for archives if specific characters start getting nuked.

Characters being added to the DNP list is exceedingly rare and not something that is readily offered, or really even offered to begin with

Artists have precedence over characters owners/commissioners in takedowns if the artist posted it
So if a character owner tries to get a piece the artist uploaded taken down, their takedown will be denied and they will need to get the artist to file a takedown
And if the artist didn't post it and the character owner has it removed, the artist can request for it to be undeleted

This whole thing is a different beast if rights are being given to commissioners, and that would be handled on a case by case basis

There is an unofficial character owner DNP list that is NOT enforced like avoid_posting and only serves as a general PSA to avoid posting their characters.
If you post or create an artwork of a "DNP character", it would not get deleted immediately but would very likely be deleted when the owner submits a takedown.

As far as artists vs. character owner rights, artists would get final say* on the artwork if it comes down to choosing between the two's wishes.
I believe commissioners and character owners can still submit takedowns as usual if there are no conflicts, unless something has changed that I don't know about.
* (Exceptions when the artists has sold the distribution/repost rights to the commissioner or character owner, or if the creation of the artwork with the character was unauthorised.)

There is only one instance I can think of where the copyright holder/character owner has complete control over their character due to them involving a lawyer, so all "NSFW fanart" of their character are prohibited, see takedown #5246.

Artworks get taken down all the time, it is also very common for artists to straight-up nuke everything from the internet and disappear.
If you have some favourites that you'd like to keep, you should already be downloading it when it gets posted.

This is a very rare case, like said before I just remember of a certain famous bear...

But yeah, if you really like some pieces I would recommend you backing them up yourself.

i could imagine someone who took the time and effort to establish a copyright for their character could serve a dmca to administration to bar them from hosting anything with that character under legal threat

Under US law at least, creators have copyright by default, barring some specific exceptions. Any character owner could in theory do such a thing, but given the policies already in place to allow owners to have their characters removed, it seems somewhat superfluous.

The ToS of many artists gives the artist sole copyright over the work, so in many cases I would bet on the character owner having no recourse

wait paddington isn't allowed on this site? wow thats actually pretty interesting. usually no childhood ruining is off limits. not that I'd actively look for Paddington art mind you just kinda surprising.

Paddington is allowed. It's just that no pornographic depictions are allowed here. (See the unofficial character DNP linked to above ) SFW pictures of Paddington are kosher.

A DNP for characters isn't practical to enforce mainly due to it being a massive headache, so you should be fine. The only way I can see people getting in trouble for it is if they keep posting or drawing the character numerous times despite constant takedowns being made. Worst case scenario outside of that, the staff will just take down your posts and move on.

Backing them is what i've been doing for years. Just hard when the artist/owner nukes them off the map with no warning.
