For tagging purposes, does a character having sex with another character who is unconscious (asleep, passed-out drunk, etc.) fit the rape tag in all instances? A search shows that rape is applied in these instances only occasionally, and I'm aware that there may be differences between tag definitions and real life definitions.

If anyone's looking for a challenge, we could also use this thread to discuss when drunk (but not quite unconscious) sex should be tagged with rape. What are the important characteristics to look for in a post? Use of force, active resistance, inability to consent, or something else?

From a fetish (as opposed to a strictly legal) point of view, these would not be rape (unless there is an explicit nonconsent element , as in a comic or sequence where previously they were told not to do that), but that's just my approach.

That seems reasonable. And thanks, I didn't know about those tags. It's interesting that both the sleep_creeping and somnophilia pages mention the rape interpretation. Is there any difference between sleep_sex and sleep_creeping, by the way?

IMO rape should be applied to any picture where consent is not given but the tag definition implies that it only applies to situations in which the other party resists in some way or asks for it to stop.

Somnophilia and Sleep sex appear to be the same thing and applied to pics where the sleeping party or both achieve orgasm.
Sleep creeping appears to be when neither or only the conscious party achieves orgasm.

Unfortunately there's no way of seeing in a picture whether or not the characters gave legally-binding consent to each-other or not. There's a lot of cases you wouldn't want to apply that rule anyway, e.g. flooding all of the young pictures with a rape tag wouldn't help anyone. =p

The tag can only really be logically applied where there is obvious restraint, fighting back, or distress.

On the other hand, being passed out / drunk in public at a party, or in a dungeon, or some other shady secluded place they appear to have been dragged to could definitely be considered rape as well, or if the other character clearly appears to be intruding on them. At the very least it'd be set up to look like rape play, so to us it'd just be rape, and personally, those are the kind of images I'd expect when looking for rape (I'd search "forced" if I wanted just the forceful kind of stuff).

sleep_creeping doesn't seem significantly different from sleep_sex. I propose aliasing sleep_creeping -> sleep_sex and somnophilia -> sleep_sex.

Some posts appear to be rape (post #175392) and some do not (post #558751). For tagging purposes, I think sleep_sex should generally not imply rape.

As resident SJW, I must state: Consent made in advance of a "disadvantaged" state where one party is well aware of his or her future state (see also: bondage) is still consent. So no, not always rape.
